To make a long story short I am stuck paying Rent for my Apartment and a Mortgage for my house and with both of them I make sure I pay them on time every month and will continue to do so, but one of them has to go because paying both of them is kicking my ass!

So what I need help with is, does anybody know of a LEGAL way that I can get out my Apartment Lease and possibly get my deposit back.

I can't continue to pay both of these and I have at least 6 months left on my lease and I rather get out my lease than my mortgage aww hell playing around with my mortgage is out the question, but the lease is up for grabs if I can get out of it somehow legally!

I know this may sound ghetto, but I can't continue to pay $950 for a 2 bedroom apt its killing me!!

i dont know about your deposit, but you can break one of the rules, like having a dog over 30 pounds. and have them kick you out. ;D

If I get kicked out I do believe I still have to pay the remainder of my lease and thats what I want to avoid. Thats why I stated LEGALLY!

But Thanks for the input

talk to your landlord about a buyout on your lease. sometimes they wil accept a partail payment and let you out early, say 250 a month. it will still cost you some money, but they can immediately rent it out and make extra on the deal.

find a loophole. There has to be something in the leae aggrement that they are not upholding. Mabey it is a broken appliance, lawn care not well enough, mabey the heater or a/c doesnt work rite....something that says they are not doing thier part. Sorry, just grasping straws here for ya. :-\

Did you talk to your landlord and ask to be just taken out of the lease? It is worth a try. It is summer, and if you live near a college area they usually go quick. Or like Puddy said put up some flyers and ask for someone to do a buyout. Not much else you can do.

Personally I would just let the money go and concentrate on the house.

Yes that is what I was going to say. Just sub lease. This way you donotlooseanythign and thenonce the original lease is up and it reverts to month to month basis the switch it over to the new guy. That is unless you have to re sign a new lease every year which is a bit strange. Other than that I would check with the coverning body on leasing liek say the rental tribunal it is called her in canada. They set the rules as tohow much a landlord canraise yourrent andhow often. You guys must have soemthing along those lines. I just don't see that if for some reason you had ot say move out of the state for work and you had just signed your lease 2 months prioer and had 10 left on it youhave to pay them 9500.00 If that is the case then just burnt eh friginplace down. then there is no problem any more.

i'm with art-man burn it down. you can always let it go to collections. if you dont plan on buying anything on credit in the next year or so. you already have a mortgage and a car or two i'm guessing. fuck them they aren't gonna starve if they have to wait for their money. i dont know about leases but if you make them wait long enough eventually they take a settlement less then the original amount. i had an electric bill from 2001 for 479.00 they settled for 71.00. i guess they felt like something was better than nothing!!! ;D
